Terms of Service

These Terms of Service ("Terms") govern your use of CoachCore (the "Platform"), operated by Alamark LLC d/b/a CoachCore ("CoachCore," "we," "us," or "our"). By accessing or using the Platform, you agree to be bound by these Terms.

1. General Terms (All Users)

1.1 Platform Overview

CoachCore is a marketplace platform that connects independent coaches with students seeking coaching services. CoachCore facilitates bookings, payments, and communications but does not provide coaching services directly.

1.2 Eligibility

You must be at least 18 years old to create a coach account. Students under 18 may use the Platform with parental consent. By using the Platform, you represent that you meet these requirements.

1.3 Account Registration

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized access to your account
• You may not transfer your account to another person

1.4 Platform Relationship

1.5 User Content

• You retain ownership of content you upload to the Platform
• By uploading content, you grant CoachCore a worldwide, non-exclusive license to use, display, and distribute your content for Platform operations
• You represent that you have the right to upload all content and that it does not violate any third-party rights
• CoachCore reserves the right to remove content that violates these Terms or applicable law

1.6 Prohibited Conduct

You may not:

• Use the Platform for any illegal purpose
• Harass, abuse, or harm other users
• Upload malicious code, viruses, or harmful content
• Attempt to circumvent the Platform's payment systems
• Scrape or collect user data without permission
• Impersonate another person or entity
• Violate any applicable laws or regulations

1.7 Intellectual Property

The Platform, including its design, features, and content (excluding user content), is owned by CoachCore and protected by intellectual property laws. You may not copy, modify, or distribute the Platform without our permission.

1.8 Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect and use your information.

1.9 Modifications to Terms

We may modify these Terms at any time. We will notify users of material changes via email or Platform notification. Continued use of the Platform after changes constitutes acceptance of the modified Terms.

1.10 Termination

• You may terminate your account at any time through account settings
• We may suspend or terminate your account if you violate these Terms
• Upon termination, your right to use the Platform ceases immediately
• Account data will be deleted 30 days after termination, except as required by law

You agree to indemnify and hold harmless CoachCore, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Platform

• Your violation of any third-party rights
• Content you upload to the Platform

1.14 Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Platform shall be resolved in the state or federal courts located in Texas, and you consent to the exclusive jurisdiction of such courts.

1.15 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

1.16 Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and CoachCore regarding the Platform.

2. Terms for Coaches

2.1 Coach Subscriptions

• Coaches must maintain an active paid subscription to use the Platform
• Subscription plans include multiple tiers with different features
• Monthly and annual subscription options are available
• Subscription fees are non-refundable, even if you cancel your account
• We reserve the right to change subscription pricing with 30 days' notice
• Failure to pay subscription fees may result in account suspension

2.2 Payment Processing

• CoachCore uses Stripe to process payments from students
• Coaches must connect a valid Stripe account to receive payments
• CoachCore currently charges 0% commission on lesson payments
• Students pay Stripe's standard processing fees (2.9% + $0.30 per transaction)
• CoachCore reserves the right to implement a platform fee of up to 1% in the future with 30 days' notice
• Coaches receive lesson payments directly to their Stripe account (minus processing fees)

2.3 Coach Obligations

Coaches are responsible for:

• Providing accurate information about their qualifications, experience, and services
• Setting clear pricing, availability, and cancellation policies
• Delivering coaching services as described and scheduled
• Responding to student inquiries and booking requests in a timely manner
• Maintaining appropriate licenses, certifications, and insurance as required by law
• Complying with all applicable laws and regulations regarding coaching services

2.4 Coach-Student Relationships

• Coaches are independent contractors, not employees or agents of CoachCore
• The coaching relationship is directly between the coach and student
• Coaches are solely responsible for the quality and safety of their services
• CoachCore is not liable for any issues arising from coaching services

2.5 Cancellations by Coaches

• Coaches may set their own cancellation policies for students
• If a coach cancels a confirmed lesson, they should issue a refund or reschedule
• Repeated cancellations may result in account suspension or termination

2.6 Refunds and Disputes

• Refund requests from students are handled at the coach's discretion
• CoachCore provides tools to process refunds but does not mandate refund policies
• Coaches should respond to refund requests within a reasonable timeframe
• Persistent disputes or fraudulent behavior may result in account termination

2.7 Coach Content and Branding

• Coaches receive a personalized subdomain (e.g., coachname.coachcore.io)
• Coaches may customize their public pages with photos, bio, and service descriptions
• Coaches retain ownership of their content but grant CoachCore a license to display it
• Coaches are responsible for ensuring their content does not violate third-party rights

2.8 Reviews and Ratings

• Students may leave reviews and ratings for coaches after lessons
• Reviews are publicly visible on coach profile pages
• CoachCore may remove reviews that violate our content policies
• Coaches may not manipulate reviews or ratings

2.9 Account Suspension or Termination

CoachCore may suspend or terminate coach accounts for:

• Violation of these Terms
• Fraudulent or deceptive practices
• Failure to deliver services as promised
• Repeated student complaints
• Non-payment of subscription fees

3. Terms for Students

3.1 Booking and Payment

• Students may book lessons with coaches through the Platform
• Payment is processed at the time of booking via Stripe
• Students are charged the lesson price plus Stripe processing fees (currently 2.9% + $0.30)
• CoachCore may implement a platform fee of up to 1% in the future with notice

3.2 Lesson Packages

• Some coaches offer lesson packages (multiple lessons at a discounted rate)
• Package credits are tracked by the Platform and expire as specified by the coach
• Unused package credits may be refundable at the coach's discretion

3.3 Cancellations by Students

• Cancellation policies are set by individual coaches
• Students should review the coach's cancellation policy before booking
• Refunds for cancellations are at the coach's discretion
• Last-minute cancellations may result in forfeiture of payment

3.4 Refund Requests

• Students may request refunds through the Platform
• The coach will review and approve or deny the refund request
• CoachCore facilitates refund processing but does not guarantee refunds
• Disputes should be resolved directly with the coach

3.5 Lesson Content and Media

• Coaches may upload photos, videos, and notes related to your lessons
• You control whether lesson notes are visible to you
• Coaches may share lesson media with you for training purposes
• You may request deletion of specific lesson content

3.6 Reviews and Feedback

• Students are encouraged to leave honest reviews after lessons
• Reviews must comply with our content policies (no harassment, false statements, etc.)
• CoachCore may remove reviews that violate our policies

3.7 Parent/Guardian Accounts

• Students under 18 must have parent/guardian consent to use the Platform
• Parents/guardians may create accounts on behalf of minors
• Parents/guardians are responsible for all bookings and payments made through their accounts

3.8 Student Obligations

Students agree to:

• Attend scheduled lessons or cancel in accordance with the coach's policy
• Treat coaches with respect and professionalism
• Provide accurate information when booking lessons
• Not misuse the Platform or engage in fraudulent activity
